Sounds to me like he was just trying to humor you by calling you back. I guess to me, technically, no, they don't have to warranty it, but I mean come on, this goes beyond just honoring a warranty, especially with so many people having the same issue. It should be about standing behind your product and getting the problem fixed, if not for free then at least heavily discounted.
