As with all the others I wish you a speedy recovery. I've had a couple of bike accidents and know the recovery is no fun but keep your head up. Just remember the important thing is you're still here for your daughter.

DUDE if you're from Washington state, you've probably seen the news. My good friend and former singer for my band lost his 3 month old son to a drunk driver sunday night. I'm about to make a thread.

Default Accident

Wishing you a speedy recovery. One thing you may want to talk with your attorney about is residual problems from this accident. My brother broke both bones in his left leg (foot was resting againts his knee) and had to have plates and screws similar to what you have. He then formed blood clots a few years later that went to his lungs and heart causing a heart attack. Mayo Hospital stated that the clots were a direct result of the previous accident, so he is now waiting on a settlement from workmans comp as this happened at work. In your case you may have on going medical problems and disabilities from this accident so you want good legal advice before you sign off on your rights.

Hey guys, I'm sorry it didnt even cross my mind to post an update on the insurance/drama side of things. I got a private message from another member and I gotta say it feels pretty good to know that people DO care about other people in general.

The sad truth is that I was pretty underinsured when the accident happened. My bike is pretty much a loss, other than what parts I can salvage off it to sell when I'm well enough to go down and work on it. I'm not so sure I will even ride again, I mean my daughter needs me around. I do have a will if anything were to happen to me but it was a little vague in areas, so that it pretty solid now. My daughter will need "help", for the rest of her life and I guess that I just took for granted the here and now. I would hate for her to ever become a ward of the state, so one good thing that came out of this is that I got my will all squared away. My insurance is covering ALL my medical bills because I have this thing called "personal injury protection", but unfortunately my lost wages and my bike are not covered. My daughter and I have been able to get by OK, my work let me cash out my vacation time and the 5 sick days I had for the year......it's a bit of a struggle but were not going hungry or anything like that.

As far as sueing the jackass that caused all this mess, you cant get something from someone who has nothing. My lawyer advised a civil suit though, his reasoning is that the guy may not have anything now, but if he ever does then I will be entitled to restitution.....he is only gonna charge me a few hundred bucks to file suit and is willing to take payments so I will do it, but I dont expect anything really.

I'm healing along ok, and I should be able to start PT in about 3 weeks. Other than that I have just been taking in all the extra quality time I have with my daughter and consider it a blessing of sorts!!!

Take care,
Jason
