Default Am I out the deposit?

I am considering canceling my order for a 1500 Longhorn and spending a little extra money to get an in stock '13 2500 diesel. I'd love to have the diesel and my main reason for ordering the 1500 was because of the interior/8spd which I can now get in the 2500 minus the 8 spd.

I would imagine as long as I buy the 2500 from them they'd let me use my deposit towards that... I haven't talked to the dealer yet but if they don't have a 2500 that I like am I out the deposit?

I can't imagine any dealer keeping your deposit, just because you didn't take delivery ... Especially if you purchase a different vehicle off their lot.

About the only way I can think of them being able to legally keep your deposit is if you signed a contract stating they can keep the deposit, if you don't take delivery.

If I were the dealer, I'd rather sell you a vehicle on the lot, unless you ordered something really crazy like a pink truck. The reason is simple... FLOOR PLAN.

Once a vehicle gets billed to a dealer, the clock starts ticking.. Depending on how a dealer finances their stock, they might have 30 or 60 days before they start paying interest on the loan, they took to purchase it from the manufacture.. So the longer a vehicle sits on a lot, the more it could cost them in Floor plan... The holdback (HB) given to the dealer is to cover the floor plan, to an extent. If they sell quick, the HB can be pure profit to them. If they go to long, before selling, it could cost them more then what they have in HB...

Yeah, I agree. Only problem now is they don't have anything close to what I want on the lot...

I concur...can't imagine them keeping the deposit. Perhaps keep waiting on your truck to arrive, and keep checking with dealer on any inbound 2500's that fit your required specs? I'm in the same boat, but I'm wanting the 3500 diesel like crabjoe. Don't need a diesel, but sure want one!

Dear god, don't do that....

Call your dealer, if your Truck hasn't been built, they can cancel (Unless they decide to just keep it). And I guarantee they will have no problem finding the perfect 2500 for you, you never know, they might even have it on the way.

If they balk at any of these options, call your CC company, or your bank, and cancel your deposit.

+1. I had a dealer try to keep my deposit when a deal fell through. I told him that I didn't sign anything stating my deposit was non-refundable and that I would dispute the charges with my credit card company if he didn't refund me. He refunded my money without a fight. I think he just had a to give it a try to see if I would be willing to leave money on the table.
