Default Catch Can vs. Emissions Inspection

So while I'm waiting on my 2013 1500 to get here, I thought I'd order a catch can. I went with the Moroso 85479. It arrived today. I couldn't help but notice that printed on the side of the box it says "Not legal for sale or use on pollution controlled vehicles". This obviously begs the question, since an under hood visual is part of the emissions inspection, will it fail? I suppose it would be easy enough to remove every year prior to the inspection. In states where an inspection is required, has anyone had trouble with it passing?

I went to a SMOG TEST only station & asked them that very question

Keep the original hose somewhere safe
In 5 years when you have to get the Ram Smog Tested
leave the can mounted, but remove the catch can hoses
put the Original hose back on for the test
when you get back home, just switch the hoses again

I will try it out next February, my 5 years will be up

What states check under the hood for emissions??? Never heard of that, here if it's 1996 or newer and has no CEL then it passes emissions.
