I agree... I've seen them working and I honestly don't think they are doing it on purpose either. They are just really careless and do not clean up AT ALL. We live in a pretty nice community and they trash the place pretty bad.

I would think that when your doing construction in an occupied neighborhood, you would tend to be a little more cautious and clean up better than they are doing. I think we've got around 180-200 houses in there right now (with people living in them). If I've got 5 neighbors/friends with nails/screws/metal in there tires within throwing distance of my house, I think it's safe to say there are more people with the problem.

Like I said, I'm not bitching just to bitch. I am picky when it comes to keeping my truck clean. I clean it all the time and the next day it's covered in crap from the construction. Almost every morning and afternoon, it's a task just to get in and out of my driveway. I don't complain about that at all, it's sort of expected.

I agree that they're in all likelihood not throwing the stuff there on purpose. I hate to see the toilet seat in their houses.

It should be treated the same way. Basically I really try not to piss on the toilet seat, but if I happen to, I clean it up.

I can just imagine... "hey, you pissed on the seat again" Yeah, so, let someone else wipe it off or sit in it. Not my problem.

Maybe...maybe it was aliens?

The "guy in charge" just gave me a call back (works for the builder). He said "We are aware of the issue, and will try our best to do a better job of cleaning up in the future, but that's all we are going to be able to do. We do not reimburse customers for things like this."

Well, I don't take things like this easily, and that didn't sit well with me. I'm pretty laid back and don't start things with other people. However, when you screw with me, you better be prepared. Looks like I'm going to have to go the legal route to get my reimbursement. I'll get it one way or the other.

Here's an idea, before you consult an attorney, how about calling your local news channel? I bet an investigative reporter showing up with a camera crew would get the point across as well as the message out to others in the area or who may be considering hiring this company for future work. I doubt it would take long after that before the company reps are out of their "meetings" and someone gets back to you, if only to make it right before their name really goes bad. If it were me, I'd start there, see what happens and if you're still not happy with the result, consult an attorney but by then, your whole community will be aware and you'd be surprised how quickly bad business and good press get around! Just a thought but good luck and let us know how it goes.

My wife brought that same suggestion up today. Tomorrow, when I get some time, I think I'll write up a story about what's going on, along with photos and submit it to the news channel. One of our news channels is always covering and investigating things like this. If they report on why some little old lady is being charged too much for Internet service, surely they would cover this.

By the way, I stopped by the place that replaced my wife's tires today. They kept the old damaged tires for me, so now I've got even more backup / evidence.

I'm sure they would cover it, they live for stuff like this but it definitely puts your problem front and center on the nightly news and who knows, an attorney might see it and consult you, but it's possible this company may give you your due restitution after that to protect their reputation and you won't be left feeling like you haven't been heard. I hope it works out for you, nice to see the little guy win once in a while!

have some flyers printed up about the issue, pay a couple of kids to place a flyer on the door step of every house in your gated community, do not have them put in a Mailbox
the flyer should read something about nails on the road or nails & screws in tires
Tell your gate guard what you intend to do & why
Take photos, your word does not count

likely you won't have to go to court, an Arbitrator could handle it

...not because there is any reason not to believe you Randy, but quite the opposite. Sounds like you're able to build a solid case. It also sounds like someone in the office is too much of a fraidy cat to confront the foreman on site. Before you take a confrontational stance, what about paying a visit to the head office with some of your evidence. Make a recording of that meeting, and then if you still are not satisfied then line up interviews and such. And do the interviewing and photo shoot on your street in the presence of tht work site .. do not tip your hat to any of that when you're at head office though.

It's pretty tough right now. I get it. You're getting no joy, and your family is out of pocket for the tires, but you have to try to remove the emotion from your next few moves. Things will iron out better, I think, if you can man.

I would also like to see pictures of the 4 non repairable tires that have nails in them. That would be a first for me and I have been on job site's my entire adult life. Sheet I have never even seen that at the landfill where I drive my dump truck on top of construction waste. getting a nail in a tire is not a easy task. every thing has to be perfect for it to get in the tire. you could dump a entire box of nails on the road and drive over them ten times and not have one in your tire. granted it does happen ! but 4 tires at once ? and non repairable ? the nail needs to be in the sidewall to be non repairable. pretty hard to get a nail in the sidewall of a tire on asphalt. again I guess it could happen. A guy looking to sue would have plenty of pictures and proof of the matter I would think. postem up and show us the 1 and a million ....
