Default What would you do?

Okay...I sold my Conquest TSI...well, kinda, and, I'm in a bit of a pickle here on what I should do.

We talked around the beginning of June, and he said he'd be down to pick the car up within the first week. Well, work got in the way, so, on June 10, 2010, I recieved a deposit from the guy so I know he's serious and to mark it as sold. I was leaving for PA on June 25th, he said he'd be picking it up on June 23rd or 24th and giving me the rest of the money.

Well, on June 22nd, he called me and said he couldn't make it to get the car, but, I was expecting the money for my trip to PA, so, he sent another $1000.

So...I'm at $2000. He then said he would pick it up the next week, and I told my dad about it and everything, but, I got a phone call saying, oh, I won't be able to make it then either. I'll just wait until you return from PA.

Well, I returned on July 20th. It took a week before I could even get a hold of him, but, he said he was in the hospital for re-hurting himself in a spot that he messed up before, and that he was going to be around the phone a lot since he's stuck on the couch for a while, I was okay with that as hospital visits are never planned...but...

At that time that I talked to him, he told me he'd give me a call on Aug 6th, (just this past Friday), because thats when he got paid, and he'd send me the rest of the money as long as I would be okay with holding the car till September. I told him I'd be okay with that, but, if anything happens to the car from sitting that long, than, thats his baby.

He was cool with that and...since this Friday, I have called him and can't get an answer. I've called him several times everyday, left him voicemails and even emailed him...so...

What I'm asking is, what would you do? And, I believe he is avoiding answering the phone because...to be honest, I don't think he has the rest of the money for it...

But anyway, this Tuesday it will be 2 months since I've recieved the deposit. I think I've been more than a nice guy letting him take this much time to pay me and pick the car up. I've had several people during this time interested in just buying and picking it up local (he's in Northern Florida). But, it seems he is impossible to ever get a hold of, and that he constantly has an excuse as to why he can't pick the car up or why he can't pay me.

Also, keep in mind, I would have never sold the car if I didn't need the money. I do like it a lot.

But...what would you do?

Try and work it out, wait a whole nother month, stretching this out over 3 months, hopefully having the deal finally come to a close?
Or, call him and tell him a date to get the car paid for and out of here or I'm listing it back up for sale, and the deposit stays with me?

Because...I'm trying to be a nice guy...but, a being a nice guy can only go so far. There's a point when you just have to be realalistic. Also, try doing this with a car dealer...haha. Think they'd be this leniant.

So...what should I do?

Start by finding out his situation. Perhaps he's back in the hospital and that's why you can't get hold of him.

Had a similar situation as you, had a vehicle up for sale, much the same as you, really liked it so was only doing it for financial reasons, but the guy gave me a deposit, also. I tried repeatedly calling him, leaving messages, not a word from the guy and he never stopped back by to either pick up the vehicle or finish paying for it. I held his deposit, like you, trying to be nice, but by that time, I didn't really need to sell the vehicle anymore, so I kept the money and my car. I mean, if I couldn't get a hold of the guy to close the deal, I couldn't get a hold of him to return his money, either, so I say oh well, his loss in your case, too. I'd give it one more good try and if you still need to sell your car, then do so. Good luck and keep us posted.

I'd wait it out. If he's serious, he'll get in touch with you.

The worst that could happen is that he'll get in touch with you and say he's gonna need his money back. That would suck...

I would put the money in an interest bearing account and let it sit for a while. If he comes back and pays the balance, then fine. If he doesn't call, you got $2000 for a little aggravation. If he wants his money back, give him $1000 and keep the other $1000 since it was a deposit. If he doesn't have any money, he can't afford a lawyer to take it to court.

He isn't getting that money back one way or the other, thats part of the whole deposit thing...its just whether or not I'll get the rest and he gets the car, or if he just forfeited it. I'm just not sure on what to tell him whenever it be that I talk to him again.

Like I said, I don't like to be a jerk, and, I'd really like this guy to get the car because he was telling me all his plans for it, how he already has a guy lined up to get it painted and he has a 2.4L DOHC turbo motor out of an eclipse he wants to drop in it and show the car, and everything else, but...I could've sold it probably 3 times to other VERY interested parties. Several others that just asked me about it.

And, I don't know about anyone else, but, if I sent $2000 as a deposit to someone for a car, I'd be down there picking it up after work one night and have to pull an all nighter and go in tired tomorrow. But, maybe I just make too much sense...I don't know.

I totally know where you are coming from.

If your deal included a deposit that was forfeited if he didn't pay the rest of the money, then it's on him to follow through.

You are making a lot of sense here. I'd be doing the same thing if I put down a deposit so for some reason he's unable to follow through. Give it some time and see what happens.

I would wait a little longer, he has given you some money, and like stated above could be back in the hospital for medical problems, or even something else.

I went through something like this where I was trying t buy a T-bird ( I was young and stupid) but after I dropped off my deposit, the seller became reluctant to sell, and it was literally 2 months of me calling him daily to try and get it sorted out so I could pay the rest and walk away. I eventually had to write off the deposit and walk away, I think 2 months is more than generous, so if he's not back to you by the end of the week, then I'd say go for the sure thing and sell it to another interested buyer.

He's been pretty decent about the money till this point . Give him a little while longer , if someone else comes up with the money , call and leave a message saying someone else is here with cash in hand and it's gotta go , then cut it loose and give him his money back .
