Yes. Because we didn't take financing through ford ... which we told them up front we didn't intend too, so it that was a condition of the offer they should have never written it.

Do you have a copy of your contract? If they change anything before financing you could sue them for breach.

By the way, all dealer financing is actually through some 3rd party banking institution. The dealer is essentially acting as a broker through the parent motor company. My mother used to be a consulting statisition for Ford motor company and I forget the legal explanation for this, but I think it's somehow anti-trust related. Likewise with insurance, they can broker, but not be the holding company.

I went over everything in my paperwork and the only thing I can see is that the deal can be cancelled if the financing application doesnt go through, then they can request the car come back within 24 hours. Now since the financing was done through them, but technically with PNC bank, Im not sure of the power they have at this point. THey have already paid off USAA for the Charger, can they have the PNC application 'cancelled' or is it out of their hands at this point. I havent had any further communications at this point but just want to be ready in case they try something. I have a stereo that is waiting to go in it but dont want to install it then find out I have 24 hours to return the car, or its towed away in the middle of the night

In my opinion they are upset that they made a blunder in their offer, sight unseen. That is the price of doing business. They don't bitch when someone pays sticker for a vehicle with no trade. If they continue to harass you contact your local BBB and Chrysler and file a complaint.

You could try contacting PNC and see if there is a loan out in your name and for what amount. That will tell you if your application was approved, and if it's the correct amount.

The bottom line is that they aren't going to loss money on the deal, they just arent going to get as much profit as they would have liked and hoped to bully more money out of you. I don't think they have a leg to stand on. They assumed the risk by engaging in a sight unseen contract.

If you've signed all the paperwork from PNC, it should be a done deal and the dealer doesn't have a leg to stand on. I'd take them some bulbs and tell them where to stick 'em!

I think you are good. If the loan is approved it sounds like the dealer doesn't have an out.

the only question i want to know is how you even got the dealer to take a trade in without even seeing it first? that is just dumb on their part and extremely awesome for you! congrats on finally sticking it to a dealer
