Default Lazy Dealership

So here is my story I traded in my 2008 Dodge Nitro for a 2011 Dodge Ram 1500 CC. The dealer gave me full trade in on the Nitro so that would be paid out not having to make payments on it only the new truck payments itís been going on 17 days and I will be having two of my payments coming out for the Nitro I no longer own because they said it will take a few days 2-3 for the financing papers to be sent out I called them today and they will not return my calls all I want is a proof of payment so I can contact the other financial company letting them know itís on its way. I donít think this should take this long. Purchased new truck June 1st 2011 and Iíve been driving the Ram since then should I still be making payments how long does it take these guys to send over the payout.

Welcome to the forum...uuummmm, sir you traded that vehicle in, the dealer most definately called for payoff. I would call your bank and tell them you traded it on 6/1...and not to take a payment. Sounds like the dealer wants you to make 2 extra payments to cover their loss...not your problem.

Then I would call the dealership and ask for the GM, explain your situation to him and find out WTF is going on. It shouldn't take this long, I wouldn't put another penny in the Nitro!

Hi and a warm Carolina welcome to the best RAM ForumZ on the web. How about posting a few photos of your truck?

I'm sorry to read of the issues with the dealer. If you have your paperwork from the sale you could fax a copy to the Loan company on the Nitro. And in your paperwork did they get a correct payoff for the Nitro? If so anything you pay should be refunded as an overpayment.

I totally agree with BlkSVT on that. Let your financial institution know the trade was done. Do you have a vehicle sales contract you can show them?

That sucks and I, too, agree with BLKSVT and the terms and conditions of your trade/purchase should all be in your paper work, so good luck and be sure to keep us posted, but I wouldn't pay any more on the Nitro, either.

I hate to throw any fuel on the fire, but you may have another issue on your hands. In most sales, there is an intent statement or two, where the it states that should there be an amount owed or underpayment, you, not the dealership, is responsible for the difference.

Case and point: I traded in my 09 Silverado, financed through Ally. My payoff was retrieved from Ally, that's what the trade in value showed in the paperwork. A payment came due on the Silverado. Ally sent me letters stating the amount due, even though it was traded in and supposedly paid. Then, a short time later, I got another letter stating that I owed them an additional $500 due to the difference of the payoff amount and the actual amount owed. A week later, I got another letter and a check. Bottom line is unfortunately this will require you to correct because neither the insurance company or dealership will have a vested interest to get it straightened up. The finance just wants the money owed and the dealership wants to get off the vehicle you traded.

Here is what i found out so far my nitro loan had a payout date May30th to June12th purchase date June 1st meaning i should not be on the hook for the nitro but the dealership never sent them papers yet today being the 16th so now the buyout price will be different and i'm still on the hook for the nitro they got there money from me and are now holding out on dealing with my end of things only good thing its they cannot sell the Nitro because of the a lien still on it so it would be in there best interest to finalize this.they tried telling me the new finance company never sent them a check for the nitro lol funny i found out they sent it before the 12 so they are stalling.
2 Nitro payment and i do even owe it anymore 1 for the Ram sure i signed for it but come on. Sorry for the venting......

Here is my opinion...I work for a dealership, and its our responsibility to get a "10 day payoff" which gives us more than enough time to "cash" the deal on your new vehichle and payoff your trade in. It is never the customer's responsibility make additional payments after the purchase/trade in is complete. If the payoff qouted was wrong (this is why we get the name of the person qouting the payoff amount and "good till" date) then it is their problem. Next person responsible is the selling dealer, but never the customer. However, stay in contact with the lender/bank that had the Nitro loan with ...if it is not resolved on time it could, right or wrong, blemish YOUR credit. Proof of the transaction will prove you're in the right, but changing a credit report is a nightmare. Good luck!

that really suxs dude and i kinda had the same problem but i called up the dealer when i found out and they paid it off right away and i never herd anything else from it but if the dealer wont answer ur calls or whatever i would go down there and talk to them and also keep in contace with the finance company or even fax them all the info showing them that the vehicle has been traded and its out of your hands cuz like stated above you do not want this to blemish your credit because of a dealers Fup....but keep us updated bud

Thats a really shatty situation to be in. I'd say just what everyone else is, use any paperwork to your advantage and stay in touch with the financing company. Good luck
