Contracts

Mutual Assent
Traditionally, mutual assent has been described as a "meeting of the minds."This means that the parties involved in a contract must come to an agreement about the particulars of the transaction. Mutual assent is demonstrated by "offer" and "acceptance."
An offer is made when someone proposes an exchange of some sort. "I will sellyou my guitar for $400" is an example of an offer. (Advertisements are usually not offers because they lack specific parties.) When the offer is accepted, the parties have mutually assented to enter into a contract.
Both offers and acceptances must be explicit in a contract. The statement "I might sell you my guitar for $400" would be considered an intent to negotiate rather than an actual offer. "Sure, I'll give you $300 for it" or "Yes, if you include the case and some strings" would not be an acceptance because the terms "accepted" are not the terms originally offered; such a statement would be deemed a counter-offer.

There are a number of valid defenses to a claim of breach of contract. As mentioned above, contracts involving minors are open to subsequent invalidation."Mutual mistake" occurs when both parties to a contract have made an erroneous assumption about something material to the contract such as the condition of a piece of equipment or the size of a parcel of land


"Misrepresentation" is also grounds for justifiable breach of contract. For example, when a certain material provision of a contract misleads one of the parties, such as claiming an automobile is in good condition when it is not, is a valid defense for breach of contract

I know its about a week late on this post but that is exactly what I would have done. Hell I would have called right there from the shop to do it.
If you tell your credit card company that the shop did unautherised work they would have no problem stopping the charge.

Not sure about where you are but out here we have the Bureau of Automotive Repair. They will crawl up this shops a$$ and then some.

That sucks man!! The stupid part is that MY muffler guy told me "I don't use FlowMasters cause they're junk.. I only install MagnaFlow"

Personally, I've always liked FlowMasters (the sound of a mid 80's Mustang sealed that deal).

We need to just tell these guys “Look, I know you're a muffler dude and I know you've probably been doing this for a long time but I'm not the new guy either. I’ve done my research and know what I want and I’m telling you what I want. By the way, I'm on the buying end of the transaction”

Man that burns me up!

I agree with the guys that what the shop did is jacked up. He's lucky he didn't get a punch in the nose for that mess.

I have a gibson system on my Hemi right now and it has a resonator before the gibson muffler. (I didn't mod the exhaust the previous owner did)

The first resonator after the y pipe most shops leave on, for whatever reason, Mine did, and i removed it and welded a piece of 3" ( i think it was) straight thru to the muffler, now its a MDS droneing SOB.

I didn't know they came from the factory that way...mine only has one resonator and it is after the muffler.
