Sounds like the heat shield is perhaps the difference maker.
As long at that intake tube isn't sitting down below the bumper and is still behind the headlight, it should be fine.

I ran a Volant with a lower intake tube on another vehicle for quite some time. We get a lot of rain here with a snow storm about every two years. I never had a problem sucking anything up.

I believe you have to be running fast and hit a huge puddle of water or bury the vehicle in a pond to really be concerned about ingesting water and hydrolocking your engine.

On the volant site it says this part number works for a 2008 ram 5.7 but on the lmp site it says it only works for 03-06, I'm going to guess its a typo but this is the site: http://www.lmperformance.com/26240/65.html. The other option is 4wheelparts.com and they have a price match which you can email and see if they give you the same price

I agree with Michael, the only issue would be if you go through standing water. Rain, snow, etc... should be no issue with drawing air from down low. There are also ways to put a safety check in (another filter higher up), so if the tube gets submerged it will then draw air from the filter higher up and not suck up the water.

Yep like that, and if you don't want to spend a lot on this you can "T" a regular filter into your intake cheaper, but these look pretty cool IMO
