Default A sad day for my Ram

This is what happens when the woman driving in the right lane just ahead of you decides to try and make a u-turn with out looking for traffic. This happened Saturday afternoon. The cops wouldn't come because there were no injuries, so she didn't get a ticket for failure to yield, improper lane change or anything else, so it is up to the insurance companies to find fault. Within 20 minutes of the accident she calls my insurance, Progressive, and claims I rear ended her and tries to make a claim. I talk to the claims rep and tell him what happens and send him pictures of the damage to show him I did not rear end her. All of this took place before Sunday night. I had yet to get a hold of her insurance company, Rio National, because they are only open Monday through Friday, like 8-7. So I finally call and get a hold of someone to make a claim Monday morning and they said a claims rep would call me within 72 hours. So my Progressive claim has moved from a guy that specializes in rear end accidents to one that specializes in this type and I have talked to both, they have talked to her and are trying to get the ball rolling and I still have a couple days to here anything from her insurance. Then this afternoon her insurance company calls me and says they are denying the claim since she wasn't insured at the time of the accident. She's basically one of the worthless f*&$ing drivers that will pay for their first month, get the insurance card that shows 6 months and just let is lapse. So now I have to make a claim on my insurance, since I can't afford to fix it out of pocket and be out my deductible. I am beyond pissed at this point. I will get a little satisfaction when I mail all of the paperwork to the state claiming she was in an accident without insurance and they revoke her license for up to a year. You can clearly see that I rear ended her.

This is the second wreck caused by a woman that I have been in, that the cops didn't come, and the woman didn't have insurance and had kids in her car.

ouch, sorry about that man id take her to court also contact your insurance company maybe they can get her for fraud since she tried to make a false clam but i dont know about these things

I would try and contact the police again since she was driving with out insurance.
Definitly take it to court. Sucks cause its more hassle and time

Glad only the truck was damaged though. Could have been worse.

I would sue in a heartbeat. I am against "sue happy" people and believe some people should just beat it out of each other but this woman needs to be punished and taught a lesson.

Not only will your truck get fixed properly you will have a reward for time and effort on your end as well.

Dang...no insurance??? That means she may not be able to afford it and has no assets to pay for your damage or even your deductible.

Oh wow, to say that sucks is putting it VERY lightly, very sorry to see and hear this! Glad it was just the truck damaged and not you, though! I would definitely document EVERYTHING, pics, conversations (the one with her "insurance" company especially, date, time and name of who you spoke to, hopefully that conversation was recorded and they can find it later when it comes time to prove it in court just in case they deny having talked to you) and I agree with hemiv8, insurance fraud/false claim on here part is an angle to consider.

I'm not in favor of frivolous lawsuits, either, but if there's a loophole that scam artists like that can fall through, she deserves the highest penalty afforded by law and yes, that means losing her license. Seems with or without insurance, she's a danger to herself and other drivers on the road. Good luck man, sure hope you can get your truck fixed soon and keep us posted, I know I'll be looking for updates on this!

Too bad about your truck, I just got mine fixed after being rearended by a DUI repeat offender. Waiting for his insurance to reimburse me(Progressive) hope they get around to it soon.

From your experience, I'd say that it'd be a good idea from now on in MO(accident happened there?) when calling cops to respond, to complain about a sore neck and back...and get it checked out.

I would go to the court system, maybe the D.A.s office & file a complaint& see what they have to say at least. She was driving illegally, she may not have a pot to pee in or a window to throw it out, but leave it to the courts.

Take lots of pix, work with your insurance company.
You may end up hitting the wrecking yards to save money

Just plain stupidity... claiming she got rear ended. Look at the damn picture

Sorry to hear man, I know how it feel dealing with people trying to cover their own ass even though clearly as you can see.. they are at fault.

Hope everything gets worked out.. sorry for the ram getting beat up though
