i recently got in a minor accident with no other cars involved. I had a front right and rear driver side blow out in my ram 1500 Daytona (a truck i love very much) fully loaded matte black SRT 10 rims a nice sound system, subs, after market tuner ect.. i went to the tow yard today and my bed cover is ripped off my front windshield smashed and my light above the back window broken and the top of the truck dented and looks like someone took a hammer to it.. it was there for less than 24 hours..so i go to the tow yard to see the damage and first of all the guys at roys towing are complete pricks to me and my friend who drove me there being complete smart asses and acting like it happened in the accident after i show them pictures of right before it was towed they finally say the bed cover must of caught wind on the flat bed and ripped off and smashing everything i said above on its way off the truck.. so my question is who's responsibility is this and who needs to pay for all the damage that was done. i don't know what to do in this situation so if anybody knows anything please help me out on how i should go about the situation i am in. A police report and insurance claim was filed for the accident but i do not know what to do about the towing dispute please help!! Thanks for your time

btw it was loaded backwards onto a flatbed truck which the tow truck driver said was the best way to go about this.

That sux! Too bad you didn't bring the cops to accompany your initial inquirey about the damage so they could have witnessed the lie. It would have been most likey stated in the report which might have made them liable. I'm glad it wasn't me, I doubt if I could have kept my composure. Good luck with it.

Was it his first day on the job? Not only is that a horrible idea for the vehicle being towed (because of things like what happened to you), but also loading heavy end facing aft beats the piss out of the hydraulics on the flat bed.

Bad situation, but here's how it will probably work in the case where you have proper insurance. Your insurance company is going to pay for all of this to get fixed properly, or total it if it's the case, but you will be fully compensated. What you will need to do is just let the ins. company sort out who pays for what. More than likely the responsible party might not even pay for what they owe, but it is what it is, you're going to be made whole either way.

The towing company has insurance that will have to pay for the additional damage if your insurance company chooses to go after them.

I would just worry about getting the truck out of the yard where it is as soon as possible and to your preferred body shop which hopefully has a secure yard. You might have to pay out the towing charge to get it over to your body shop but be there when it's towed so something doesn't happen again. It might sit at the body shop lot for a week before the adjuster even gets to it. Take a pic of it and let us see. If it's that bad you might be out of a ride for a month and a half or even more depending on the shop. Hopefully you have rental car as part of your ins.

When you contact your insurance company about the damages they may question the other damage depending what has been listed on the TR report by the investigating officer.....I would let them know up front that this damage occurred by the towing agency and that show them the pics that were taken......

This is more than likely not the first time for this towing company so I would also contact your surrounding agencies such as the bbb......Your insurance company should go after the tow company however just be prepared to answer some questions and do not let the buck get passed.....
